He returned to England and sought out the King who was in Wales. He offered to do homage for his inheritance, but Henry, at the suggestion of Hubert de Burgh, Justicar of England, declined, under the plea that the late Earl's widow was pregnant. Richard was ordered to leave the realm within fifteen days, and left for Ireland where his brothers were with an Army. They seized Castle Pembroke, and prepared to enforce his rights. King Henry, fearing open war, accepted his homage and recognized him as the Earl of Pembroke.
    • Miscellaneous: Oct 1231; In October 1231 he opposed the King's proposed marriage to a sister of the King of Scots. A year later he was on of the four Earls who became sureties for Hubert de burgh. In early 1233, he led the Barons in appealing to the King to dismiss his foreign advisers. The advisers (from France) drove him into open rebellion, and in August he was proclaimed a traitor and the office of Marshal was declared forfeited. Richard then made an alliance with Llewelym and carried out successful warfare against the royal forces. At the same time the Lacy faction was ravaging Ireland. In February 1233/34, he crossed to Ireland where he took Limerick and recovered some of his castles. Anabortive conference with the rebels at the Curragh of Kildare on 1 April 1234 was followed by a battle in which he was greatly outnumbered and defeated, wounded and captured.

    • Military: 1236; Gilbert captured Castell Meredydd from Morgan ap Hywel in 1236 during a truce between Llywelyn the Great and King Henry III of England. After Marshal took the castle he seems to have fortified it with a bailey and curtain wall. He was forced to return it to Morgan by the terms of the truce, or "for fear of the lord Llywelyn".

    He was mortally wounded at a tournament at Ware, which King Henry III had expressly forbidden, as he did not want any of his subjects killing one another in sport. Gilbert was thrown from his horse and his foot was caught in the stirrup, thus he was dragged for some distance on the ground and died from the injuries received.

    While his body was buried beside his father and brother in the Temple Church, his entrails were buried in Herford Priory.

In 1265, he fought in the Battle of Evesham under Prince Edward. The next year he commanded the royalist forces at Chesterfield. He received pardon for his actions in 1267, and the next year on 24 June he took up the cross. It appears however that he never went on Crusade. Two years later, in 1269, he violently quarreled with Sir Alan la Zouche in Westminster Hall, the result being that Sir Alan died of his wounds. Sir Alan's son barely escaped with his life. Earl John fled to Reigate being perused by Prince Edward. He begged for mercy, and on 4 August 1270, was pardoned, having agreed to pay a large sum to the King. Four days after the King's death, Sir John swore allegiance to Prince Edward. As Prince Edward was at that time returning home from Crusade, Earl John was appointed one of the Guardians of the Realm. In 1277 and 1294, he was summoned to serve against the Welsh, and was summoned to serve against the Scots in 1291, 1297, and 1300.
    • Military: 27 Apr 1296; On 27 April 1296, Earl John defeated the Scots at the Battle of Dunbar. The next year in August his advance guard under Henry de Percy was attacked, though the attack was repelled. He continued on the Battle of Sterling, where he was defeated on 10 September 1269. He fled to Berwick, but he soon abandoned it. Later he commanded the rear guard at the Battle of Falkirk on 22 July 1298. He commanded the second division at the siege of Caerlaverock Castle in 1300.

    • Military: 1283; In 1283 together with his brother Roger Mortimer, Baron of Chirk, John Giffard, and Roger Lestrange, he devised a plan to trap Llywelyn ap Gruffudd. Edmund, a great-grandson of Llywelyn the Great, sent a message to his kinsman Llywelyn, grandson of Llywelyn the Great, telling him he was coming to Llywelyn's aid and arranged to meet with him at Builth. At Irfon Bridge the Welsh prince became separated from his army. Edmund's brothers secretly forded the river behind Llywelyn's army and surprised the Welsh. In the resulting battle Llywelyn was killed and beheaded. Edmund then sent his brother Roger Mortimer of Chirk to present Llywelyn's severed head to King Edward I of England at Rhuddlan Castle. The head was displayed on the Tower of London as a warning to all rebels.
